4 COMPETITION DETAILS

4.1 RULES AND REGULATIONS

4.1.1 Competition Promoter

The National Department of Arts and Culture, South Africa

4.1.2 Invitation

The National Department of Arts and Culture of South Africa invites eligible architects to submit architectural design proposals for the nation-wide design competition of the Sarah Bartmann Centre of Remembrance. The competition will be conducted in two stages according to the UNESCO rules and instructions outlined in this document.

4.1.3 Accreditation

The competition is accredited by the following institution:

  I. South African Institute of Architects (SAIA).

The brief is formulated in compliance with UNESCO Standard Recommendations for International Architectural, Urban Planning Competitions and UIA Instructions for International Competitions and Urban Planning.

4.1.4 Eligibility

The following are eligible to participate in the competition:

  I. The competition is aimed at any professional Architect registered with the South African Council for the Architectural Profession (SACAP);
  II.
Architectural teams participating in the competition shall have at least one (1) licensed/certified/registered/authorised architect who will be the team leader.

The following shall not be eligible for entry in the competition:

  I. Any architect being part of the Advisory Committee, the Reference Group, the jury, or expert advisor to the jury or the Competition Co-ordinators;
  II.
Any person who is closely associated to, or professionally associated with or in the employment of any member of the Reference Group, the Advisory Committee, the jury, Technical Assistance to jury or the Competition Co-ordinators;
  III. Any South African Government employee.

4.1.5 Registration

Competitors are required to register in order to enter the competition. Entrants shall only be registered as competitors when (date), and not later than, they have:

  I. Paid the prescribed fee of R 100, which is non-refundable;
  II.
Accepted the “Declaration and Undertaking”;
  III. Provided notification of their name(s), company, postal and physical address, e-mail address, telephone and fax number.

The competitors will be required to pay the entry fee via internet banking (within South Africa) or by bank deposit. Cash payment will not be accepted. Prior to payment of the registration fee, the following registration procedures must be followed:

  I.

Competitors should complete the Registration form on the competition website, accept the Declaration and Undertaking and provide the individual competitor or team representative's full names and nationality; full contact details including e-mail addresses as well as telephone and fax numbers. Upon receipt of a competitor's registration details in the competition database, e-mail notification will be forwarded to the competitor with instructions on how to proceed with payment of the competition registration fee;

  II.

Once payment of the registration fee has been verified by the Competition Co-ordinator, an unlock code will be sent by e-mail to provide access to documentation regarding the competition.

4.1.6 Anonymity

Competitors shall remain anonymous until the judging of the second stage has been completed. No drawing or document shall carry the names of any of the competitors, or any logo or other mark which may serve to identify the competitor. The only exception is the content of the sealed and opaque envelope with the inscription "Identification".

The procedure to preserve anonymity will be the same for both stages and will be as follows:

  I.
First stage submissions will be presented anonymously with an identification code chosen by the competitor, a seven (7) digit code made up of letters and/or numbers, 10mm high. The seven (7) digit code will be such that the competitor's identity will not be revealed. Prior to the jury meeting, the Competition Co-ordinator will be responsible for ensuring that the competitor's identification codes are registered and that serial numbers are attributed to each competition entry. The competitors' codes will be masked and replaced by the serial number on all the pieces submitted. It is this serial number that will be used as a reference for the jury during deliberations. After the judging of the first stage has been completed, the sealed envelopes shall be opened by an independent auditor, who shall inform the finalists of the results.
  II.
Second stage submissions shall include the same code number attached to all drawings and to a sealed envelope containing the competitors names. Finalists shall take all reasonable steps to ensure that their participation in the second stage of the competition remains strictly confidential.
  III.
Anonymity will be lifted when the jury has declared the results at the end of the second stage. Non-prize winning competitors who wish to remain anonymous during the public exhibition of projects, should indicate their wish to remain anonymous in a separate declaration in the "Identification" envelope.

4.1.7 Disqualification

A design shall be disqualified by the jury if:

  I.
It is received after the stipulated date and time. At its sole discretion the jury may accept late submissions if there is evidence that such submissions were posted by priority mail or delivered to a courier seven full calendar days before the required submission date;
  II.
It is not the entry of a registered competitor;
  III.
In the opinion of the jury, it substantially fails to provide the accommodation required by, or meet other stated requirements of the brief;
  IV.
The drawings and other documents submitted fail substantially to comply with the stated requirements;
  V.
The author discloses his or her identity or improperly attempts to influence the decision;
  VI.
Any condition or instruction, other than that of a minor nature, has in the opinion of the jury been disregarded.

4.1.8 Questions

Competitors in both stages of the competition shall have the opportunity to pose questions and to obtain clarification. All questions should only be in English. All questions must be e-mailed or faxed to the Competition Co-ordinator and should reach the Competition Co-ordinator by the dates specified in section 4.6. Questions received after these dates will not be answered. All competitors will be able to view all questions and answers via the competition website. The memorandum containing these answers shall then form part of the competition instructions. Answers to questions shall be made available on the internet at the following URL:

4.1.9 Copyright

In terms of copyright, the following will apply:

  I.
The design, awarded first prize, can only be used by the Promoter upon his commissioning the author as architect for the project;
  II.
Copyright of the design, drawings and associated material submitted by the winner shall, after the author having been formally appointed as architect, and subject to the provisions contained in paragraph 4.5.1 (iii), become the property of, and vest in, the South African Government in its Department of Arts and Culture. Provisions regarding copyright of any further products, generated as part of the commission, will be regulated/governed by the conditions of contract applicable to the appointment entered into (refer paragraph 4.5.1 (iii));
  III.
No other design, entered in the competition, whether it has been awarded a prize or not, may be used wholly or in part by the Promoter except by agreement with the author;
  IV.
The extent of the use referred to in sub-paragraph (iii) above, contractual relationships to be created as a result thereof and remuneration related thereto will form part of the negotiation for such use. Negotiations in this regard will be in good faith with the conditions of contract referred to in paragraph 4.5.1 (iii) as basis. Agreement thus reached will be reduced to writing in a contract between the author and the Promoter. It will be an explicit condition that, upon the conclusion of such contract, the subject of copyright will be dealt with in the same way as for the winning entry covered in sub-paragraph (ii) above;
  V.
By submission of a competition design, a competitor agrees to free reproduction and exhibition of his/her competition design for the promotion of the competition and its results by the Promoter. Images of the winning, and any other, designs may be published by SAIA and the Promoter on their respective websites and/or newsletters/magazines;
  VI.
In all cases, unless otherwise stated in the regulations, the author of any design shall retain the right of reproduction only after the announcement of the competition results in the second stage. Should it happen before the announcement of the competition results, their designs shall be eliminated.
  VII.
All competitors are required to acknowledge all their sources, particularly those pertaining to indigenous knowledge of the KhoiSan people. They are also required to reimburse their sources for any indigenous information passed on, and provide proof of such reimbursement.

4.1.10 Retention of submission after the competition for exhibition and publication

The Promoter reserves the right to retain submissions for exhibition and to publish submissions. All first stage submissions will be retained until after the second stage adjudication has been completed. All designs, including those disqualified by the jury, shall be exhibited and selected entries from the first stage may be published. Non-winning competitors, who wish to remain anonymous for public exhibition and publications, should express this in writing in the sealed "Identification" envelope submitted with the project. The above provision will not apply to stage two participants. SAIA and the Promoter will publish the results of the competition and images of the winning entries on its website and newsletter. The exhibition of entries will be organised after the competition. The exhibition venue and dates will be communicated to all participants, and to SAIA. The Promoter shall not be obliged to return submissions to competitors. Competitors may however arrange to have submissions collected after the Promoter has completed exhibition stage. All drawings and plans, other than those which have received prizes or been purchased and are retained by the Promoter, shall be destroyed at the end of the public exhibition.

4.1.11 Loss of and/or damage to submissions

Competitors are responsible for their entries until they reach the competition office, and competitors can take out insurance for the time of transport. However, submissions will become the responsibility of the Promoter as soon as they are received by the competition office.
